L'aborto nel contesto dei diritti fondamentali

Abstract

Il presente studio e' dedicato al tema dell'aborto inserito nel piu' generale contesto dei diritti umani. L'Autore, dopo aver svolto un'analisi approfondita circa i principali aspetti e le problematiche connesse alla disciplina giuridica e agli strumenti di tutela previsti per i diritti fondamentali, ha approfondito gli aspetti piu' rilevanti del "diritto all'aborto" al fine di chiarire come questo possa essere considerato un diritto fondamentale, cosi' come previsto dalla Costituzione italiana. Il diritto all'aborto, infatti, pur non essendo annoverato tra i diritti inviolabili espressamente previsti dalla Carta costituzionale italiana, e' riconosciuto dalla stessa come appartenente a quella categoria di diritti che, pur non essendo espressamente previsti dalla Costituzione, vengono riconosciuti dalla coscienza sociale come fondamentali in un determinato momento storico e, pertanto, meritevoli di appartenere alla categoria dei diritti inviolabili sancito dall'art. 2 Cost. Facendo riferimento al percorso giurisprudenziale in materia, sono state messe in evidenza le strettissime connessioni esistenti tra il diritto all'aborto e il diritto alla salute, dal momento che proprio queste connessioni consentono di qualificare il diritto all'aborto come un diritto fondamentale che viene, quindi, a godere della protezione tanto dell'art. 2 (posto a tutela dei diritti inviolabili) quanto dell'art. 32 (posto a tutela del diritto alla salute) della Costituzione. L'aborto, infatti, puo' essere riconosciuto come diritto fondamentale solo se messo in relazione con la norma costituzionale che sancisce il diritto alla salute, ossia nel momento in cui possa essere inteso come diritto posto a tutela della salute della gestante.

This study is dedicated to the theme of abortion within the more general context of human rights. The author, after having analyzed the principle aspects and problems connected with the law and the instruments for safeguarding fundamental rights, focused on the most relevant aspects of the "right to abortion" with the aim of clarifying how this can be considered a fundamental right, as provided for by the Italian Constitution. The right to abortion, in fact, even if it is not among the inviolable rights expressly provided for by the Italian Constitutional Court, is recognized by the same court as belonging to the category of rights that, even if not expressly provided for by the Constitution, is recognized by social conscience as fundamental in a given historical moment and, therefore, merits belonging to the category of inviolable rights sanctioned by article 2 of the Constitution. With reference to the legal course, the close connections existing between the right to abortion and the right ho health were highlighted, as just these connections allow the right to abortion to be classified as a fundamental right that thus is protected by art. 2 (which safeguards inviolable rights) as well as article 32 (safeguarding the right ho health) of the Constitution. Abortion, in fact, can be recognized as a fundamental right only if related to the constitutional law that sanctions the right to health. that is, when it is intended as a right to safeguard the health of the pregnant woman.
